Terms of Service — Polls & Surveys

1. Acceptance of Terms
By installing or using the Polls & Surveys app (“the App”) from the Wix App Market, you (“Site Owner”) agree to these Terms of Service. If you do not agree, do not install the App.
2. Description of Service
Polls & Surveys is a Wix App Market application that lets you create polls and surveys, display them on your Wix website through a widget, collect votes and optional lead emails from visitors, view results and analytics, and export the data. Some features are available only under a paid subscription.
3. License
Subject to your compliance with these Terms, we grant you a non-exclusive, non-transferable, revocable license to install and use the App on Wix websites you own or manage.
4. Your Responsibilities
You are responsible for the content of the polls you create and for the personal data you collect from your visitors through the App, including votes and — if you enable the lead-capture step — email addresses. You must:
- have a lawful basis for collecting and processing that data;
- disclose the collection in your own site’s privacy policy, including the use of
a de-duplication fingerprint derived from the visitor’s IP address and one
localStoragetoken; - honour data-subject requests using the export and delete tools in the dashboard.
You may not use the App for unlawful purposes, to collect data from children in violation of applicable law, or to send unsolicited messages to collected emails.
5. Prohibited Uses
You may not reverse engineer, decompile, or attempt to extract the source code of the App; resell or sublicense it; or create derivative works based on it.
6. Free and Paid Plans
Free plan: create polls of all six types, show live results, export to CSV, view analytics, and apply an accent colour, font, and light or dark mode. The free plan allows up to three active polls at a time.
Paid plan: removes the active-poll limit and unlocks saved themes, the full appearance token editor, custom Google fonts, custom CSS, and removal of the footer credit. Payments are processed by Wix through the Wix Billing System. Subscriptions renew automatically unless cancelled. If plans change, existing subscribers keep access to what they already paid for.
Refunds: subject to Wix’s standard refund policy for App Market subscriptions.
7. Service Availability
We strive to keep the App in good working order but do not guarantee uninterrupted availability, freedom from bugs, or compatibility with every browser, device, or third-party Wix app. We may modify, suspend, or discontinue the App with reasonable notice.
8. Limitation of Liability
To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, or consequential damages, or for loss of business, revenue, or data. Your sole remedy for dissatisfaction with the App is to uninstall it.
9. Indemnification
You agree to indemnify and hold us harmless from any claims, damages, or expenses arising from your use of the App, your polls and collected data, your violation of these Terms, or your violation of any third-party rights.
10. Changes to Terms
We may update these Terms from time to time. The “Last updated” date above reflects the latest revision. Continued use of the App after changes constitutes acceptance.
11. Governing Law
These Terms are governed by the laws of the jurisdiction in which the developer is located, without regard to conflict-of-law principles.
