Terms of Service — Testimonials Wall

1. Acceptance of Terms
By installing or using the Testimonials Wall app (“the App”) from the Wix App Market, you (“Site Owner”) agree to these Terms of Service. If you do not agree, do not install the App.
2. Description of Service
Testimonials Wall is a Wix App Market application that lets you keep a library of customer testimonials, display them on your Wix website through a widget in several layouts, and collect new testimonials from visitors through a form you moderate. Some features are available only under a paid subscription.
3. License
Subject to your compliance with these Terms, we grant you a non-exclusive, non-transferable, revocable license to install and use the App on Wix websites you own or manage.
4. Your Responsibilities
You are responsible for the testimonials, texts, links and images you publish. In particular you must:
- publish only genuine testimonials from real customers, in their own words, with their permission — never invented, paid-for or misleading reviews, which are unlawful in many countries (for example under the US FTC rule on fake reviews and testimonials and EU consumer-protection law);
- disclose any material connection (for example a gift or discount given for a review) where the law requires it;
- use only photos and logos you own or are allowed to use;
- review testimonials sent through the collect form before approving them.
Sample testimonials added when the App is first opened are for illustration only and are never shown on your published site. You may not use the App for unlawful purposes or to mislead visitors.
5. Prohibited Uses
You may not reverse engineer, decompile, or attempt to extract the source code of the App; resell or sublicense it; or create derivative works based on it.
6. Free and Paid Plans
Free plan: one live wall showing up to 12 testimonials, grid, carousel and list layouts, three themes, the collect form, spreadsheet import and a rating summary. A small “Powered by Testimonials Wall” line is shown under the widget.
Premium plan: unlimited live walls, up to 200 testimonials per wall, masonry, moving ticker and spotlight layouts, all themes, custom colors and fonts, and removal of the “Powered by” line. Payments are processed by Wix through the Wix Billing System. Subscriptions renew automatically unless cancelled. If plans change, existing subscribers keep access to what they already paid for.
Refunds: subject to Wix’s standard refund policy for App Market subscriptions.
7. Service Availability
We strive to keep the App in good working order but do not guarantee uninterrupted availability, freedom from bugs, or compatibility with every browser, device, or third-party Wix app. We may modify, suspend, or discontinue the App with reasonable notice.
8. Limitation of Liability
To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, or consequential damages, or for loss of business, revenue, or data, including losses that result from testimonials you published or approved. Your sole remedy for dissatisfaction with the App is to uninstall it.
9. Indemnification
You agree to indemnify and hold us harmless from any claims, damages, or expenses arising from your use of the App, the testimonials and other content you publish with it, your violation of these Terms, or your violation of any third-party rights.
10. Changes to Terms
We may update these Terms from time to time. The “Last updated” date above reflects the latest revision. Continued use of the App after changes constitutes acceptance.
11. Governing Law
These Terms are governed by the laws of the jurisdiction in which the developer is located, without regard to conflict-of-law principles.
