Terms of Service — Seasonal Effects

1. Acceptance of Terms
By installing or using the Seasonal Effects app (“the App”) from the Wix App Market, you (“Site Owner”) agree to these Terms of Service. If you do not agree, do not install the App.
2. Description of Service
Seasonal Effects is a Wix App Market application that shows falling effects (such as snow, hearts, confetti and leaves), decorations, bursts and cursor trails over the pages of your Wix website, on dates and pages you choose. Some features are available only under a paid subscription.
3. License
Subject to your compliance with these Terms, we grant you a non-exclusive, non-transferable, revocable license to install and use the App on Wix websites you own or manage.
4. Your Responsibilities
You are responsible for the emoji and images you add to an effect, which must be content you are entitled to use, and for checking the effect on your published site. Holiday dates that move every year (for example Easter, Ramadan, Lunar New Year, Diwali, Hanukkah, Thanksgiving and Mother’s Day) are set by you.
5. Prohibited Uses
You may not reverse engineer, decompile, or attempt to extract the source code of the App; resell or sublicense it; or create derivative works based on it.
6. Free and Paid Plans
Free plan: all holiday presets and falling effects with every setting, one date range, all pages or the home page only, the phone and stop-button options, and no branding on your site.
Premium plan: dated holiday campaigns that repeat every year, decorations (lights, bunting, cobwebs), fireworks and confetti bursts, cursor trails, your own emoji and images, and chosen pages. Payments are processed by Wix through the Wix Billing System. Subscriptions renew automatically unless cancelled. Returning to the Free plan keeps your Premium settings; only the Free parts show on your site until you upgrade again.
Refunds: subject to Wix’s standard refund policy for App Market subscriptions.
7. Service Availability
We strive to keep the App in good working order but do not guarantee uninterrupted availability or freedom from bugs. A saved change can take up to a minute to reach your live site. We may modify, suspend, or discontinue the App with reasonable notice.
8. Limitation of Liability
To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, or consequential damages, or for loss of business, revenue, or data. Your sole remedy for dissatisfaction with the App is to uninstall it.
9. Indemnification
You agree to indemnify and hold us harmless from any claims, damages, or expenses arising from your use of the App, the content you add to it, your violation of these Terms, or your violation of any third-party rights.
10. Changes to Terms
We may update these Terms from time to time. The “Last updated” date above reflects the latest revision. Continued use of the App after changes constitutes acceptance.
11. Governing Law
These Terms are governed by the laws of the jurisdiction in which the developer is located, without regard to conflict-of-law principles.
